Photo Acquisition Terms

Permissions Grant

By responding to our request with the hashtag #PrenateYes, you grant to Prenate^®, its affiliates, subsidiaries, advertising, and promotional agencies, and their agents, the irrevocable, unrestricted, royalty-free right to use, store, publish, display, reproduce, edit, modify and distribute any materials, content, illustrations, photos, videos, comments, or information relating to the photo (content), including those bearing your name, voice, image, likeness, and/or any other identifiable representation of yourself.

Warranties and Representations

By responding to our request with the hashtag #PrenateYes, you warrant and represent that:

• You own all rights to the content, or alternatively, have the right to grant us the rights to the content.
• Your content does not infringe upon the copyrights, trademarks, rights of privacy, publicity, or other intellectual property or other rights of any person or entity.
• You have been given permission from all persons whose name, voice, image, likeness, and/or any other identifiable representation are included in the content.
• You will indemnify and hold harmless Prenate^® from any claims to the contrary.

Reservation of Rights

Prenate^® reserves the right to alter, change or modify the content, in its sole discretion. You hereby waive any right you may have to inspect or approve the finished materials or any part or element thereof.

We may decline to accept content for any reason with or without notice. We may remove content we have previously published for any reason with or without notice.

Content may be subject to other terms and rights, including but not limited to those outlined in the Instagram terms of service.

Acknowledgment and Agreement

By responding to our request with the hashtag #PrenateYes, you hereby acknowledge and agree to the above in consideration of the opportunity given to you by Prenate^® to appear or have your content appear in our promotional materials. You acknowledge that you have fully read and understand this document and that you have had any questions answered to your satisfaction. You certify that you are at least 18 years of age.
